Martha Barrera, then 45, claimed a vehicle operated by Norma Langus ran a stop sign at a Broward County intersection in September 2010, hitting the front driver’s side of Barrera’s vehicle. Barrera sued Langus for negligence, and Langus conceded. After emergency room neck pain complaints, Barrera had an MRI that showed a C3-4 disc herniation. She claimed pain and daily activities limitations. Her treating orthopedist said her injury was permanent and will require medical care. The defense’s expert orthopedist claimed the injury was pre-existing and due to age, not the crash. But the jury found the crash was a legal cause of injury and awarded Barrera $150,680.
