A jury in Broward County declined to award damages to a man who insisted his car slammed into a tractor-trailer because the truck driver was inattentive.

On an evening in January 2008, Steven Kaminik, 42, was driving a sedan west on West Indiantown Road in Jupiter. An approaching tractor-trailer made a left turn in front of him. His car broadsided the tractor-trailer. Kaminik claimed spine injuries, which make it difficult for him to walk, stand or sit for long periods. His counsel alleged the truck driver, Benitho Occes, lacked time to safely complete the turn, and the truck lacked proper markers or reflective tape.
