A constitutional challenge to the state workers’ compensation law was thwarted Wednesday by the Third District Court of Appeal and will not be reviewed by the Florida Supreme Court.

The appellate court reversed Miami-Dade Circuit Judge Jorge Cueto’s ruling that the law is unconstitutional while blocking a path to Tallahassee for the controversy. Instead the case—without the crucial constitutional claim—will return to Cueto for further proceedings like those of any other workers’ comp matter.
