Selecting The Right Mediator
Kammer: Selecting the right mediator is the first step to the successful resolution of your case. The key to mediation is trust. Accordingly, it is helpful if the attorneys know the mediator in order to avoid any impression that the mediator is favoring one side. Also consider how your client will react to the mediator. Do you need a mediator who is forceful or one who is a good listener? Finally, consider the mediator’s background, especially if your client is sophisticated, as the mediator’s knowledge of the subject area lends credibility to her view of the case.
