An estate has been cleared in a premises liability case.

Christopher Engdall, a laborer, sued Eugene McHugh after Engdall fell off a ladder while transporting supplies to the roof of McHugh’s home in Davie in 2010. McHugh, in his 80s, died shortly after the suit was filed, and the estate represented the defendant. Engdall, who was diagnosed with a wrist fracture and a foot fracture, claimed on his third descent the 12-foot ladder slipped, and he fell. Engdall assumed McHugh was holding the ladder.
