Kelley visited the city’s workers’ compensation medical center as required for city employees when injured on duty, complained of neck pain, had X-rays and was discharged. He was diagnosed with C3-4, C4-5 disc herniations and underwent a cervical fusion. He sought $1.4 million in damages.
