Private homeowners have prevailed in a property rights case.

Chester Chmielewski and wife Katherine claimed the quiet enjoyment of their 1975-acquired beachfront property was violated after the city of St. Pete Beach took title to an adjacent property. When the city developed the property into an arts center and small park, the Chmielewskis complained center events subjected them to loud noises, littering, public invasion and denial of quiet enjoyment rights.
