A Costco store in Fort Myers was not at fault for the injuries of a customer who slipped on a puddle at the store’s entrance, a Lee County jury found. Roderick Davis, 50, a restaurant manager, slipped on rain water as he was pushing a flatbed cart near the Costco doors. He claimed he injured his neck, back, and left shoulder. Davis sued Costco Wholesale Corp., alleging the store failed to maintain its premises in a reasonably safe condition. He sought damages for medical expenses and for pain and suffering between $145,000 and $160,000. Costco claimed Davis had not taken reasonable care and had been walking too quickly. The jury found that there was no negligence on the part of Costco.
