A jury found a Miami store was not liable for a trip and fall that a patron claimed caused torn menisci in her right knee.
Maria Baron, then 57, tripped on an empty pallet on the floor of a Costco. She alleged the empty pallet violated Costco’s policies and created a tripping hazard when she stepped back to allow another customer to pass. Baron alleged Costco failed to maintain its store in a reasonably safe condition because the pallet was a hidden trap.
