A jury found the city of Miami was not liable for wrist and elbow injuries that a woman claimed resulted from a fall on a sidewalk. Miriam Rosello, then 69, was walking on the sidewalk at 520 SW 14th St. when she tripped and fell. She sustained an ulna fracture to her left wrist and an ulna fracture to the elbow of her dominant right arm. She claimed she tripped over an uneven section of the brick paved sidewalk. She claimed the section of sidewalk was significantly uneven and broken. She claimed the city failed to properly maintain the sidewalk in a reasonably safe condition.

Defense counsel claimed the city did not have actual or constructive notice of the sidewalk’s condition.
