A jury decided a longtime smoker was not addicted to nicotine in Philip Morris cigarettes.

Phyllis Surico, 63, was diagnosed with lung cancer in Volusia County and died two months later. Her estate alleged that as a result of her smoking, Surico became addicted to nicotine and suffered from lung cancer, which caused her death. They claimed she began smoking as a teen before the package warnings of the health hazards and addictive nature of cigarettes were required.
