A jury awarded $35,970 to a man who claimed a motor vehicle collision led to a permanent lower back injury.
John Piretti, then 59, was driving his 2005 Mazda Tribute sport utility vehicle on Pierson Road in Palm Beach County when he was rear-ended by a 2002 BMW 525i operated by Daniel Miteff, who conceded liability. Piretti was diagnosed with lumbar spondylolisthesis, sciatic nerve damage and radiculopathy. His treating orthopedic opined he had a 10 percent impairment rating caused by his injury. His treating physiatrist opined his sciatic nerve damage caused the spondylolisthesis.
