A jury awarded $142,554 to a man who claimed he suffered multiple injuries when his sedan was forced into a raised median. Arnaldo Mayrink, then 26, was driving northbound in the left lane of McGregor Boulevard near Bay Drive in Fort Myers. Marile Luchsinger, who was driving a sedan in the right lane, tried to move into his lane. To avoid an impact with her car, he was forced to turn his sedan away and collided with the median. He claimed he hurt his neck, shoulder, right arm, chest and back. He said he has residual lower back pain. The defense’s expert orthopedist opined that the back injury was not caused by the accident. He suggested that it was chronic based on the fact that he continued to work in his physically demanding painting job.
