A jury found that a woman was not liable for an accident in a parking lot that a man claimed resulted in a torn shoulder. Lazaro Gomez, then 30, was driving his sedan in a shopping center near Northwest 54th Street in Miami-Dade. As he was entering the lot, his vehicle was rear-ended by a sedan driven by Martha Viera. Gomez was diagnosed with a right labrum tear. He claimed he had the right of way when Viera failed to stop at a designated stop line. Viera claimed she stopped before proceeding and did not see Gomez until the impact. She claimed he wasn’t paying attention and failed to keep a proper lookout. The defense claimed Gomez’s injury was pre-existing and he was involved in a prior accident in which he complained of the same injury.
