Miami-Dade Circuit Senior Judge Jon Gordon went too far when he struck the pleadings of a woman accused of lying during a foreclosure bench trial, according to a state appellate court, which reversed and remanded the case to a new judge.

Gordon was presiding over a May 2015 foreclosure trial pitting Bank of New York Mellon against homeowner Vilma Violetta Martinez. His sanction wiped out all of Martinez’s responses and motions in a case dating back to 2008. He then entered a default judgment in the bank’s favor, and suggested he’d considered throwing Martinez in jail for perjury.
