Following a brief detour through the Florida courts system, a dispute between two giants of South Florida real estate over an affordable housing project in New York City appears headed back north for arbitration.
The Third District Court of Appeal denied a request from a construction contractor owned by developer Ugo Colombo, Glasswall LLC, which was looking to stay arbitration of a contractual dispute in New York. Glasswall has filed several lawsuits in Miami-Dade circuit court attempting to settle differences with the builders of the Hunter’s Point South Commons affordable housing project in Queens, New York. But those builders, including development giant the Related Cos., have argued Glasswall is bound by an arbitration clause to resolve any issues by mediation, and that the proper jurisdiction for such an action is in New York.
