The Associated General Contractors of America is seeking passage of a bill that would amend Chapter 558, Florida Statutes, Florida’s Notice and Opportunity to Cure statute. The proposed amendments are of significance to those in the construction industry, including general contractors, subcontractors, suppliers, architects and engineers.

The Florida Legislature enacted Chapter 558 in 2003 as an alternative dispute resolution mechanism to resolve construction defect disputes in an effort to reduce the number of lawsuits and to reduce the associated costs of litigation, while at the same time protecting the rights of property owners. The statute sets forth a procedure for homeowner associations, owners, contractors and others who participated in the design and construction of a property to follow, prior to the filing of a lawsuit for construction defects.
