othstein Rosenfeldt Adler receiver Herbert Stettin wants to interview employees to find two external computer hard drives missing from the law firm, which collapsed after fraud allegations targeted chairman Scott Rothstein.
Berger Singerman attorney Chuck Lichtman, representing the receiver, filed an emergency motion asking to depose people about the missing drives as soon as possible and without much notice. One of the drives belonged to the firm, and another backed up information for an unidentified “RRA attorney.”
Lichtman said the receiver doesn’t know if the drives were taken, mislabeled or inadvertently misplaced.
He also is seeking custody of a computer used by a firm administrator, Sabrina Kurzman, who was “purportedly close” to Rothstein, according to the motion. Rothstein was ousted from the firm last week.
Kurzman started doing work for the firm and Rothstein from her Cooper City home about six months ago and could have some needed documents in her possession, according to the motion filed Tuesday in Broward Circuit Court. It only recently became available in the court file. Lichtman said he has recovered Kurzman’s computer but not the missing hard drives.
Kurzman was one of six or seven firm employees who worked off-site, Lichtman said. The others are spread across the country, and the receiver is in the process of obtaining their computers.
The receiver is also locking employees and attorneys out of the firm’s computer system. Stettin and his attorneys are working with The Florida Bar to ensure Rothstein Rosenfeldt Adler lawyers and staff with ongoing cases have access to the digital files. The firm has consented to an involuntary bankruptcy filing.
The FBI announced Thursday that an alleged fraud involving structured settlements offered by Rothstein may be worth $1 billion. Federal agents raided the firm’s ocean-view Fort Lauderdale office last week.
