Broward County Court Judge Robert Diaz didn’t want to impose a mandatory $5,000 civil penalty against a man charged with soliciting a prostitute, but a state appeals court had no trouble with the fine.
Diaz accepted Nelson Vachon’s no contest plea and found the fine imposed under Section 796.07(6) of the Florida Statutes unconstitutionally excessive.
