Here’s a cautionary tale about serving court documents: There’s probably no one named “Lazareth Fracis.”

One lender learned this the hard way when the real subject of the court papers, foreclosure defendant Nazareth Solomon, successfully argued no litigation had started against her because the plaintiff had served “Fracis.” In other words: the lender’s own documentation suggested a violation of Florida’s Rules of Civil Procedure because “Fracis” had notice of the lawsuit, while Solomon never got word of the legal action against her.
