A Fort Lauderdale jury Thursday returned a nearly $43.97 million verdict for former Miami Dolphins quarterback Dan Marino and a group of prominent investors who accused Wachovia Mortgage Corp. of costing them millions on a failed real estate project.

The group sued for negligent performance of contract, among other counts, over Wachovia’s inadvertent disclosure of customer information through an email blast. That misstep allegedly led to class action lawsuits and caused 119 would-be buyers who had each paid deposits of about $80,000 to cancel their sale contracts.
