A state appellate court found it had “no choice but to reverse” a criminal contempt finding against foreclosure defense attorney Stuart Golant, who was handcuffed and jailed after tussling with bailiffs.

The Fourth District Court of Appeal ruled Palm Beach Circuit Senior Judge Howard Harrison failed to follow the correct procedure after a heated exchange that ended with Golant handcuffed and jailed. It wiped out the charge and $500 fine against the Boca Raton lawyer, ruling Harrison didn’t go far enough to put Golant on notice.
