On April 28, the Florida Supreme Court issued its heavily anticipated decision in Castellanos v. Next Door, declaring the workers’ compensation statutory attorney fee calculation unconstitutional.

The court did this once before in 2008 in Murray v. Mariner Health. However, the Legislature answered the Murray decision by amending the statute to limit fees to a statutory calculation. This limitation in the law led to an attorney fee award in the Castellanos case which amounted to $1.53 per hour.
