The Florida Supreme Court ruled Thursday that Miami’s police oversight panel doesn’t have the power to subpoena an officer accused of harassing a woman during a traffic incident.

The ruling is a victory for the Fraternal Order of Police, a fierce opponent of the city’s independent Civilian Investigative Panel, and for Third District Court of Appeal Judge Leslie Rothenberg. Rothenberg, who takes office as Third District chief judge next week, dissented from two panel opinions that favored the oversight board and seemed to aim at keeping the case from getting to the high court.
