The U.S. Department of Housing and Urban Development issued guidance that affects housing providers who use criminal backgrounds against prospective tenants.

In an attempt to protect people with criminal histories from housing discrimination, HUD has warned providers to think twice before turning away a potential resident just because of an arrest or criminal record. The provision particularly affects homeowner associations that have blanket provisions against residents with an arrest record or felony conviction, said Jed Frankel, a partner with Eisinger, Brown, Lewis, Frankel & Chaiet in Hollywood.
