Five years after Congress passed the Genetic Information Nondiscrimination Act of 2008, the U.S. Equal Employment Opportunity Commission has fired its opening enforcement salvo with the filing of two lawsuits against employers for violations. In so doing, the EEOC is making good on its promise to focus on genetic discrimination as one of its enforcement priorities.

Congress enacted GINA in response to the scientific advances in genetic testing to ensure that people did not forgo testing out of fear that the results could compromise their insurability or employability.
