A Monroe County circuit judge made four errors when he ruled a developer could store stone crab and lobster traps on No Name Key instead of building 13 homes, a state appellate panel said Wednesday.

Circuit Judge Mark Jones misapplied a Florida Supreme Court holding, improperly considered neighboring subdivisions in determining developer Galleon Bay Corp.’s investment expectations, misinterpreted the word “and” to mean “or” and improperly relied on expert testimony that the developer’s 13 lots should be used for trap storage, the Third District Court of Appeal said.
