I don‘t know about the United States, but in many other countries around the world, mediation is actively encouraged by the courts and in some cases it is a mandatory requirement before court for all the reasons given in this article. The reason for making it mandatory is that despite these benefits, there is still a lot of resistance from parties and from lawyers to the process. There‘s an interesting video on mediatoracademy.com where international commercial mediator Diana Paraguacuto talks about why people resist mediation despite the benefits.
