    I tried a case against both Stuart and Scott in 2001. I had known them both for many years. I liked Stuart and never really thought much good of Scott. Stuart and Scott were very different people.

    When Scott absconded to Morocco, Stuart had been appointed to arbitrate a case of mine. My opponent asked me to talk to Stuart about the necessity that he withdraw. Stuart was understanding, but insisted he was unaware of the Ponzi scheme. We had long talks about the firm, the scheme, and his earnings. Certainly Stuart had been tragically naive. But on the central question, was he aware of the Ponzi scheme, I believed him then and I believe him now. I am pleased that the Government has come to that view.

    I deeply regret that Stuart‘s association with Scott will deprive him of the ability to do what he loves best-practice law. He made serious mistakes, but he practiced our profession honorably and with distinction.
