Regulators, consumers and lawyers are taking a skeptical eye toward hidden and fraudulent fees that are often described as “pass through” charges.

In a recently filed class action lawsuit in the Southern District of Florida, AutoNation Inc. faces off against consumers who claim that the largest car retailer in the U.S. surprised its customers with unanticipated and undisclosed service charges in violation of Florida law. According to the class representatives, the deceptive charges—which are listed as miscellaneous on the invoices and are not disclosed to customers before the service or repair—have illegally increased Fort Lauderdale-based AutoNation’s profits.
