Tort of malicious prosecution questioned in cases

Attorney Grasford W. Smith says the Fourth DCA didn't make the subject of a tort for malicious prosecution any clearer last month by finding that the litigation privilege does not protect attorneys from a malicious prosecution action in appropriate cases.
