A three-judge panel of the 3rd District Court of Appeal has ruled that Citibank violated the procedural due process rights of a North Miami Beach condominium association because it failed to properly notify the association’s attorneys of a hearing to cancel a foreclosure sale.

In October 2008, Citibank filed an action to foreclose on a condominium unit owned by Ramon Escobar, naming Escobar and Jade Winds Association as defendants. Jade Winds cross-claimed against Escobar, seeking payment of past due association fees and costs, and in April 2009, the court entered a judgment in favor of Jade Winds. The association took title to the property in August 2009.
