A police explanation for the warrantless search of a stopped car did not pass the legal sniff test, a Long Island judge has ruled.
The prosecution argued in People v. Kim, NA271123/2009, that the search of the car pulled over for speeding in Valley Stream on Oct. 8, 2009, was justified when Nassau County Police Officer Daniel Dowsett noticed “a strong odor of marijuana coming from the vehicle.”
